XM Satellite Radio (NSDQ: XMSR) has settled a lawsuit brought by EMI against the firm over the Pioneer Inno digital media player, which has live recording capabilities. This is the last of the four major record labels to settle the suit filed in 2006, and the terms were not disclosed. XM said the case is not fully resolved yet, as some indie labels and music publishers still have to settle with XM, but it is working on it.

The suit was part of an RIAA lawsuit brought in 2006, claiming that the device obligated XM to pay an additional licensing fee. At that time RIAA claimed the ability to record from XM and store music on the MP3 player was “massive wholesale infringement.” XM held its ground initially, insisting that the device should be treated no differently than a VCR. The agreement not only covers Inno, but other future devices with the the same capabilities.
